დავის მიზეზია მეოცე მუხლი, რომელიც ტელე-რადიო პროდუქციის შესყიდვას ეხება. მოქმედი რედაქციით, სხვადასხვა სახის პროდუქციის შეძენის დროს მაუწყებელი სახელმწიფო შესყიდვების შესახებ კანონს უნდა დაემორჩილოს, რაც, თავის მხრივ, ტელევიზიას კერძო არხებთან შედარებით არაკონკურენტულ გარემოში აყენებს.
მიზეზი კი ისაა, რომ ტენდერის დროს უპრატესობა დაბალფასიან და, ზოგ შემთხვევაში, დაბალხარისხიან პროდუქტს ენიჭება.
მაუწყებელი ითხოვს, რომ გამონაკლისი იქნას დაშვებული და ტენდერის ჩატარებისას მსგავსი რეგულაცია გადაცემებზე, ფილმებსა და სერიალებზე აღარ გავრცელდეს.
